General Terms and Conditions

 

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from dearlydots GbR (hereinafter: "dearlydots" or "we") to consumers. A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity.

 

2. Contracting Party

The purchase contract is concluded with dearlydots GbR, represented by the partners Lena Rasmus-John and Anne Hornschuh, Elvira-Tuszik-Str. 43, 50769 Cologne.

 

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.

3.2. By clicking the "Buy Now" button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation email immediately after receiving your order.

 

4. Right of Withdrawal

4.1. If you are a consumer, you have a right of withdrawal in accordance with the statutory provisions.

4.2. If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you shall bear the regular costs of returning the goods. We kindly ask you to use outer packaging for the return. 

4.3. Furthermore, the provisions set out in detail in the following apply to the right of withdrawal:

 

Right of Withdrawal Information 

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, dearlydots GbR, Elvira-Tuszik-Str. 43, 50769 Cologne - info@dearlydots.com, by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. We kindly ask you to return the goods to us in outer packaging. 

 

Consequences of Withdrawal

 

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us or to (here, if applicable, insert the name and address of the person authorized by you to receive the goods) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

 
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices and Shipping Costs

5.1. The prices listed on the product pages include the statutory value-added tax and other price components.

5.2. In addition to the stated prices, we charge a flat rate of EUR 4.90 per order for delivery within Germany. Shipping costs are displayed in the shopping cart and during checkout. Shipping costs are waived for orders over EUR 75.00. 

 

6. Delivery

6.1. Delivery is only available within Germany with Deutsche Post and DHL GoGreen. 

6.2. Shipping takes place within 1-3 working days. The total delivery time is approx. 2-7 working days (depending on the destination). We will indicate any differing delivery times on the respective product page. 

6.3. If an item from the Coming Soon section is ordered together with other items, we will generally ship all items once the Coming Soon item is in stock. Should you wish for an earlier shipment of your partial order, please contact us at hallo@dearlydots.com or info@dearlydots.com.  

7. Payment

Payment is made by credit card, Paypal or Klarna.

 

8. Retention of title

The goods remain our property until full payment has been received.

 

9. Warranty for defects

dearlydots is liable for material defects according to the applicable legal provisions, in particular §§ 434 et seq. of the German Civil Code.

 

10. Dispute Resolution

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
